The Board of County Commissioners, in and for Lake County, Ohio, met this day in regular session with the following members present:

Commissioners: Aufuldish, Sines and Troy

Commissioner Troy presented the following resolution and moved its adoption.

 

RESOLUTION DECLARING CERTAIN LAKE COUNTY PROPERTY SURPLUS OR OBSOLETE AND NOT NEEDED FOR THE USE FOR WHICH IT WAS ACQUIRED, AUTHORIZING A PUBLIC INTERNET AUCTION FOR THE SALE OF SURPLUS LAKE COUNTY PERSONAL PROPERTY ACCORDING TO SECTION 307.12 OF THE OHIO REVISED CODE AND AUTHORIZING ADVERTISING FOR SAME

 

WHEREAS, the Board of County Commissioners hereby finds and determines that all formal actions relative to the adoption of this resolution were taken in an open meeting of this Board of County Commissioners, and that all the deliberations of this Board of County Commissioners and of its committees, if any, which resulted in formal actions, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Revised Code; and

 

 WHEREAS, Section 307.12 of the Ohio Revised Code provides for the sale of surplus personal property of the County under the criteria enumerated in that statute, and

 

WHEREAS, on March 6, 2003 the Board authorized an online auction and adopted rules for Online Surplus Property Disposition and amended the rules August 26, 2004. Said rules are incorporated herein by reference and made part of this resolution.

 

NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners finds that Lake County has surplus personal property not needed for public use, or that is obsolete or unfit for the use for which it was acquired and that such personal property has a fair market value in excess of $2,500.00 and that such personal property shall be offered for sale by public Internet auction, the net proceeds of which shall be deposited in the County's General Fund and ultimately credited to the various departments as appropriate.

 

BE IT FURTHER RESOLVED, that the Board of County Commissioners, in and for Lake County, Ohio, hereby authorizes the Clerk of the Board to advertise its intention to conduct a public online surplus auction for the sale of such personal property of the County and to conduct said auction  pursuant to the agreement  for implementation services, online surplus property network, and procurement/reverse auction services between the Lake County Board of Commissioners and LightGov Inc. (Contact-David Engler, 100 DeBartolo Place, Suite #225, Boardman, OH 44512).  Such auction is to be held continually on the Lake County Website accessible at www.lakecountyohio.org and bids shall be accepted for 30 days or longer at the discretion of Lake County.

 

BE IT FURTHER RESOLVED, that the Clerk of the Board is hereby directed to forward certified copies of this resolution to the Lake County Auditor; Budget Director; Lake County Administrator; Rich Winter-Central Purchasing; Donna Tyson-Commissioners= Finance Department; David Engler, LightGov Inc., 860 Boardman-Canfield Rd., Ste. #204, Youngstown, OH  44512-4235. 

Commissioner Sines seconded the resolution and the roll being called upon its adoption, the vote resulted as follows:

Lake County

Rules for Online Surplus Property Disposition

 

Lake County hereby creates the following rules pursuant to Ohio Revised Code 307.12 and the powers inherent in the County=s Charter:

 

1.      The Lake County Board of Commissioners has determined that surplus property including motor vehicles acquired for the use of County Officers and departments, and road machinery, equipment, tools, or supplies, which is not needed for the public use, or is obsolete or unfit for the use it was acquired is appropriate to be sold by Internet auction.

2.       By resolution adopted March 6, 2003, the Board of Commissioners of Lake County declared its intent to sell property through the Internet and on August 26, 2004 amended the rules governing the auction.

3.      The auctions shall be conducted on a continuous basis through accessing the Lake County surplus property on the Lake County website located at www.lakecountyohio.org.

4.      The surplus property will first be listed under the Lake County online classified section of the Internet presence for 90 days in order that political jurisdictions from within Lake County can choose to identify such property to acquire at the place identified in the classified listing at no cost.

5.      If the property is not acquired in the first 90 days of listing in the online classified section then the property will be transferred to the live auction listing for a period of no less than 30 days but such time may be extended at the discretion of Lake County in order to maximize the financial return to the County.

6.      The County on an item-by-item basis may determine minimum price or reserve price for that item.  Such information shall be available on the website.

7.      Each item sold is sold Aas is@.  Lake County makes no warranties or representation regarding any surplus sold.

8.      The County will direct the highest bidder where to pick up the surplus property and at what time through email notification or notification placed on the auction site.

9.      A certified check shall be delivered to the County=s designated agent at the time the winning bidder acquires the property.  The winning bidder will be notified by email within 10 days of the end date of the auction.

10.  The highest bid for the surplus property will prevail.  However Lake County reserves the right to withdraw the offer if the highest bidder is purchasing the surplus for a use contrary to the health and welfare of Lake County or its citizens.

11.  The Board of Commissioners has contracted with LightGov to provide the software necessary for completing the Internet auction.

12.  The County will also post a notice of such Internet auction in a conspicuous place in the County Administration Building and in the County Courthouse on a continuous basis.

13.  A notice will appear continuously on the County=s website that surplus property is available through Internet auction.
